Article 17. PBD, PLANNED BUSINESS DISTRICT


Section 17.01 Statement of Purpose

The PBD Planned Business District is primarily a commercial district intended to permit, with Township approval, private and/or public development in a coordinated and cohesive arrangement which may be more difficult to achieve under more conventional, piecemeal development designed to conform with standard zoning requirements. To that end it becomes possible to permit greater flexibility in the types of land uses, land use arrangements and development requirements than would otherwise apply. It is further intended that the C-5 District be located along major thoroughfares, such as M-59, as opposed to locations in residential neighborhood areas where conflicts of land uses may arise more easily.

Development standards, as approved in a development plan, in this district shall result in a project that is superior to one constructed under standard zoning requirements and shall be mutually acceptable to the applicant(s) and the Township. Therefore, any PBD Plan shall be substantially consistent with the Township Master Plan, desirable principals of land use planning, zoning ordinance standards and other applicable development requirements. In order to achieve these objectives, approval of a PBD development requires approval of both a Site Plan and PBD Agreement which sets forth specific physical, functional, amenity and design features and other related requirements considered essential to the development.


Section 17.02 Permitted Uses

The following uses are permitted in the PBD District:

A. Those uses identified as permitted or special land uses in the following Districts: LB, Local Business; RB, Restricted Business; GB, General Business; and NB-O Neighborhood Office subject to the application of appropriate standards and conditions of approval found in this section.

B. Other ancillary uses when it can be demonstrated that such uses are secondary and complementary to the principal intended use(s). Ancillary type uses which may be considered include: single-family residential uses, multi-family residential uses, and recreational uses. All industrial uses shall be prohibited. In any such situation these ancillary uses shall be of such size, configuration and location that they reflect established and desirable principles of land use planning and represent viable land use proposals. In addition, any such ancillary use(s) shall provide a physical, functional and aesthetic environment which facilitates the desirable short and long term use of the subject area involved; and, any such ancillary use(s) shall also be compatible with abutting and neighboring land uses and provide any necessary transitional devices to ensure such compatibility.


Section 17.03 Accessory Uses

A. Any accessory use permitted in the Rl-A, Rl-B, Rl-C, Rl-D, RM-1, RM-2, NB-O, LB, RB, and GB Zoning Districts.

B. Signs in accordance with Section 4.28.


Section 17.04 Development Regulations

All PBD Planned Business Development District developments shall be reviewed in accordance with Section 4.51 – Planned Development Review Process and Section 4.52 – Site Plan Review and Approval.
